Rules of Engagement:

On Net to Off Net:

• Promotional Products include: Metro Ethernet Private and Dedicated; Metro Ethernet eLAN and eHUB 1Gig and above; WDM 2.5 and 10 Gig Basic and Enhanced unprotected and protected; Metro IP 100 mbps and above; Long Haul Waves with Managed or Unmanaged Tails; Core Wave; and FOI where, for any of these, one of the locations is Off-Net.
  
  
• Deals cannot be combined with other promotions.
  
  
• 2 or 3 year contract minimum.
  
  
• For the ONE location OFF-NET (up to 1500 ft. from Backbone via SE MapPoint), then there will be NO CHARGE for the Off-Net lateral and riser (does not include special cases such as railroad, bridges or river crossings).
  
  
• For the ONE location ON NET in building riser charges will be waived for qualified promotion deals only.
  
  
• Customer is responsible to secure building access rights for lateral and riser construction.
  
  
• The customer contract and first invoice will prominently indicate NRC Credit for the no charge build up to 1500 ft.  
  
  
• If a customer is greater than 1500 ft. from our Backbone first 1500 ft. of construction charges will be waived and the customer would be required to pay for the additional footage via NRC or NRC / MRC conversion.
  
  
• Off-Net Promo does NOT apply to Standard Ethernet or 1 Gig WDM Waves.
  
  
• Promotion good until September 30th, 2010.

All contracts must be fully executed by Customer and countersigned by AboveNet by September 30th, 2010 to qualify for the promotion.
